Official Contest Rules

A complete copy of these rules can be obtained at the offices of Cumulus Broadcasting LLC, 225 NW Hollywood Boulevard, Fort Walton Beach, FL  32548, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

CUMULUS/FORT WALTON BEACH RADIO STATIONS will conduct registration & giveaway during the 2013 Billy Bowlegs Festival (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

1. No purchase is necessary. Void where prohibited.  All federal, state, and local regulations apply.
2. Must be a legal U.S. resident at least 18 years of age in order to participate in and win the Contest.
3. The Contest is open to the general public, except for employees, agents, representatives, or affiliates of CUMULUS/FORT WALTON BEACH RADIO STATIONS, Cumulus Broadcasting LLC, all other radio industry employees, and their immediate family members.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.  To be eligible listeners must have a valid social security number and working telephone number and/or e-mail address when qualifying and at the time they are selected as a prize winner; individuals who do not satisfy these eligibility and other requirements will be declared ineligible to win the Contest.
4. An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest.  Any individual who has won a prize or combination of prizes valued at more than $600 from any Cumulus Broadcasting station within the past year is not eligible to participate in or win the Contest.
5. The Contest will be conducted on Friday, May 31, 2013, from 3-9 p.m. and on Saturday, June 1, 2013, between 11 a.m.-8 p.m. or until 2,500 attempts by contestants to open vault are made (the “Contest Period”). 
6. To participate in the Contest, contestants must visit the Cumulus/Fort Walton Beach radio station booth located at the Gazebo at The Landing, Fort Walton Beach, FL, between during the contest period outlined above.  ONLY ONE ATTEMPT PER PERSON WILL BE ACCEPTED.  2500 FINALIST(S) WILL BE SELECTED FOR THE CHANCE TO PARTICIPATE IN THE CONTEST. FINALIST(S) MUST BE PRESENT TO WIN. 2500 finalist(s) will each be given the opportunity to attempt the contest by recording a (6) digit random number code onto the official sign in form obtained at The Landing Fort Walton Beach,  and entering that code into the digital lock on the prize vault. In order to be a valid attempt, each eligible contestant must: (1) print and sign their full name, along with their (6) digit number code on the first unoccupied line provided official contest sign-in registration form, (2) after completing this information, the contestant may then enter their (6) digit number code into the digital lock on the prize vault followed by * key on the key pad.
7. The grand prize is $10,000.00 CASH. There will be a guaranteed prize of a $500 Mojo Sportswear gift certificate awarded to one randomly drawn contestant.
8. In order for the grand prize to be awarded, the code recorded by the contestant on the official sign-in form and entered by the contestant into the digital lock must exactly match the predetermined winning code selected for this contest by the insurance provider that is contained in the sealed security envelope. THE ACT OF OPENING THE DOOR TO THE PRIZE DOES NOT CONSTITUTE A WINNING ATTEMPT. (See American Hole n’One rules).  There will be a guaranteed prize of a $500 Mojo Sportswear gift certificate awarded to one of the contestants selected via random drawing on Monday, June 3^rd.
9. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or combination of prizes valued at more than $600 during a calendar year will be issued an IRS Form 1099 to report their winnings.  All those who win a prize or combination of prizes valued at more than $600 on any Cumulus Broadcasting station will not be eligible to win another prize or combination of prizes of equal or greater value for one year thereafter.
10. All prizes are awarded “as is.” Prizes are nontransferable and cannot be sold, exchanged or redeemed for prizes or cash.  The station shall not be responsible for the failure of participating sponsors to deliver prizes as promised.
11. Odds of being selected depend on a number of factors including the number of eligible entries received. The odds of winning the contest once selected as an official finalists are 1:1,000,000
12. Neither the station nor Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, employees, agents or representatives shall be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
13. Prizes must be claimed in person at the event or at radio station during regular business hours and within ten (10) business days of winning to claim the Prize. As a condition to receiving the prize, the winner must present a state issued photo ID and complete the applicable winner’s paperwork, including a Winner’s Affidavit and Release, releasing the station, Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize.  Failure to timely claim the prize will result in ownership of the prize reverting back to the station to be disposed of at its discretion, and the winner then loses all claims and rights to said prize.   
14. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the station to be used, disposed of or destroyed at the discretion of the station.
15. All entrants and winners agree to give the Station and Cumulus Broadcasting LLC, and their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation,  unless prohibited by law.  All winners release, discharge, and agree to save harmless Cumulus Broadcasting LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against the Station or Cumulus Broadcasting LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that Cumulus Broadcasting LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Broadcasting LLC.
16. By participating in the Contest, each participant agrees to receive email communications from the Station regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest.  By participating in the Contest, where allowed by law, participants agree that the Station may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 
17. By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
18. A list of winners may be obtained after all winners have been determined by sending a self-addressed stamped envelope to the following address:

CONDITIONAL PRIZE CONTEST

Contest Dates:

This contest will take place on the following event date(s):  5/31/13 through 6/1/13. This promotion is subject to all federal, state, and local laws, and is void where prohibited by law.

Who May Enter & Who is Eligible:

This promotional contest is open to legal residents of the United States age 18  and older with a valid federal or state identification except the following classes of persons who are ineligible to participate:

1. Employees or family members of employees of Cumulus/Fort Walton Beach Radio Stations, Cumulus Broadcasting LLC, Mojo Sportswear, the Greater Fort Walton Beach Chamber of Commerce, American Hole n’ One, or any other promotional agency otherwise associated with this event are not eligible to participate or win this contest.
2. Persons who have won another contest or promotion of any kind from Cumulus/Fort Walton Beach Radio Stations within 30 calendar days before the contest are not eligible to participate or win this contest.

How to Play:

There is no purchase necessary to enter or participate in the contest. Contest can be entered at The Landing Fort Walton Beach on 5/31/2013 from 3-9 p.m. and on 6/1/2013 from 11 a.m.-8 p.m. or until 2,500 attempts have been made.* Contestants may enter only once. (2500)  finalist(s) will be selected for the chance to participate in the contest.  Finalist(s) must be present to win.  Difficulties with getting to locations to enter the contest are not the responsibility of WKSM-FM, WZNS-FM, WNCV-FM, WYZB-FM, WFTW-AM, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce.  *(2500) finalist(s) will each be given the opportunity to attempt the contest by recording a (6) digit random number code onto the official sign-in form, and entering that code into the digital lock on the prize vault.  In order to be a valid attempt, each eligible contestant must:

1. Print and sign their full name, along with their (6) digit number code on the first unoccupied line of the provided official contest sign-in registration form.
2. After completing this information, the contestant may then enter their (6) digit number code into the digital lock on the prize vault, followed by the * key on the key pad.

In order to claim the Grand Prize:

1. In order for the grand prize to be awarded, the code recorded by the contestant on the official sign-in form and entered by the contestant into the digital lock must exactly match the predetermined winning code selected for this contest by the insurance provider that is contained in the sealed security envelope.  The act of opening the door to the prize vault does not constitute a winning attempt.  In order to be considered a winning attempt:

1. An eligible contestant must record the winning (6) digit code on the sign-in registration form;
2. Trigger the locking mechanism and open the prize vault only by means of entering that winning (6) digit code into the locking mechanism; AND
3. The contestant’s code must exactly match the predetermined winning code selected by the insurance provider that is contained in the sealed security envelope, and that was preprogrammed by the insurance provider into the electronic digital lock.

2. The grand prize will not be awarded as a result of any of the following reasons including, but not limited to:

1. Any code recorded by the contestant on the sign-in form and entered into the digital lock that does not match the predetermined winning code contained in the sealed security envelope, and programmed into the lock by the insurance provider.
2. Any contestant who is able to open the prize vault door using a non-winning code for any reason including physically forcing entry, equipment damage, or malfunction.
3. Any tampering with the prize vault or locking mechanism that results in the prize vault door being opened.
4. Any malfunction of the locking mechanism, electronic digital lock or prize vault that results in the prize vault being opened with a non-winning code.
5. A contestant that records a winning code on the official sign-in form, but fails to properly enter that code into the digital locking mechanism, and thereby triggering the locking mechanism.

3. In the event of a winner, the winner will be required to sign an eligibility affidavit and liability release waiver before the prize will be awarded. The winner must come to Cumulus/Fort Walton Beach at a mutually agreed date and time at least 2 weeks prior to delivery of the grand prize. The winning contestant will also be required to submit a copy of valid identification (driver’s license), and a copy of their social security card.
4. Winner acknowledges that American Hole ‘n One and Mojo Sportswear, Cumulus/Fort Walton, and/or The Greater Fort Walton Beach Chamber of Commerce have the right to publicize your name, character likeness, photograph, voice and the fact that you are a grand prize winner without further authorization or financial remuneration.
5. Prizes awarded are non-transferable. Failure to collect the prize constitutes forfeiture of the prize. If forfeited, prize will remain property of Cumulus/Fort Walton and/or Mojo Sportswear. Another winner will not be selected.
6. If the winner is found to be in violation of these rules, he/she may be required to forfeit his/her prize.

Prizes:

The grand prize for this contest is $10,000.00 Cash.  A maximum of (1) grand prize(s) will be awarded in the event that the official contest finalist meets all contest requirements described above, and the terms and conditions of the sponsor’s contract. Prizes are non-transferable and are not redeemable for cash or alternative prize substitution. All taxes and associated fees are the responsibility of the grand prize winner. If no finalist successfully matches the predetermined (6) digit number code in exact order according to the contest rules and contract terms and conditions, no grand prize will be awarded. Total prize value is approximately $10,000.00 Cash.  Cumulus/Fort Walton, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce are not responsible for and will provide no warranties regarding the use of the grand prize. For a winner list, please send a self-addressed stamped envelope to Cumulus/Fort Walton Beach Radio Stations, 225 NW Hollywood Blvd., Fort Walton Beach, FL 32548.

Restrictions:

Cumulus/Fort Walton Beach, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce reserve the right to make rule or contest changes without notice at any time and reserve the right to change the aforementioned contest date(s) without notice. The decision Cumulus/Fort Walton Beach, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce management in the interpretation of these rules is final. Cumulus/Fort Walton Beach, Mojo Sportswear, and/or The Greater Fort Walton Beach Chamber of Commerce, their representatives, agencies and employees are not responsible for any liabilities arising directly or indirectly from the award or use of this prize.  Cumulus/Fort Walton Beach, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce, their representatives, agencies and employees are not responsible for any changes or difficulties in travel or prize delivery. The decision of Cumulus/Fort Walton Beach, Mojo Sportswear and/or The Greater Fort Walton Beach Chamber of Commerce management in the interpretation of these rules is final. By participating, persons agree to be bound by the decisions of the judges and the official contest rules.

Odds:

The odds of being selected as an official finalist are dependent upon the number of entries. The odds of winning the contest once selected as an official finalist are 1: 1,000,000.
